Custodial violence

  1. Bhagwan Singh and Anr. v. State of Punjab, 1992 (3) SCC 249 (accused were police officers and deceased died in their custody but dead body not traced - witnesses establish fact that deceased arrested and severely beaten up - accused convicted).



  2. Gauri Shanker Sharma v. State of U.P., AIR 1990 SC 709 (Death in police custody must be seriously viewed for otherwise we will help take a stride in the direction of police raj. It must be curbed with a heavy hand.).



  3. Khatri v. State of Bihar (II), AIR 1981 SC 928a (blinded prisoners - directions issued by Court regarding payment of cost of their treatment, lodging and boarding and further stayed trial till its compliance but not investigation of offences alleged to have been committed by blinded prisoners).



  4. Munshi Singh Gautam (D) and Ors. v. State of M.P., AIR 2005 SC 402 (Custodial violence - importance of identification test).

  7. Sebastian M. Hongary v. Union of India, (II) (1984) 3 SCC 82 (in a writ of habeas corpus, exemplary costs to be awarded on failure of the detaining authority to produce the missing persons, on the conclusion that they were not alive and had met an unnatural death).

Union of India (UOI) and Ors., (I) AIR 1984 SC 571(in a petition for writ of habeas corpus, the burden obviously on the respondents to make good the positive stand - when it is shown that the person detained was last seen alive under the surveillance, control, and command of the detaining authority).
